que\u00a0<strong>cientos de venezolanos deportados de Estados Unidos a El Salvador bajo una ley de tiempos de guerra del siglo XVIII deben tener la oportunidad de impugnar sus detenciones<\/strong>, y el Gobierno de Trump debe facilitar los desaf\u00edos legales.<\/p>\n<p>En su fallo,\u00a0<strong>Boasberg escribi\u00f3 que los individuos fueron deportados sin notificaci\u00f3n adecuada ni derecho a impugnar sus expulsiones<\/strong>.<\/p>\n<p>\u201c<strong>Ese proceso, que se les neg\u00f3 indebidamente, ahora debe serles otorgado<\/strong>\u201d, escribi\u00f3 Boasberg.<\/p>\n<p>A lo que agreg\u00f3: \u201cSin este alivio,\u00a0<strong>el Gobierno podr\u00eda secuestrar a cualquiera<\/strong>, entregarlo a un pa\u00eds extranjero y, en la pr\u00e1ctica, impedir cualquier medida mi\u00e9rcoles,\u00a0<strong>Boasberg tambi\u00e9n cit\u00f3 el fallo de la Corte Suprema en un caso separado que confirm\u00f3 la orden de un tribunal inferior<\/strong>\u00a0para que la administraci\u00f3n facilitara el regreso de\u00a0<strong>Kilmar Abrego Garc\u00eda,<\/strong>\u00a0un migrante salvadore\u00f1o que vive en Maryland y que fue deportado a El Salvador a pesar de un fallo judicial anterior de que no fuera enviado all\u00ed.<\/p>\n<p>No obstante, la\u00a0<strong>Corte Suprema<\/strong>\u00a0anul\u00f3 una orden del juez en ese caso de que el Gobierno \u201chiciera efectivo\u201d el regreso de Abrego Garc\u00eda, citando la deferencia que los tribunales deben dar al Gobierno en asuntos de pol\u00edtica exterior.<\/p>\n<p>Sin embargo,\u00a0<strong>Boasberg no lleg\u00f3 a ordenar expresamente al Gobierno de Trump que devuelva a Estados Unidos a los cientos de inmigrantes venezolanos<\/strong>\u00a0que se encuentran actualmente detenidos en una mega la\u00a0<strong>Administraci\u00f3n Trump<\/strong>\u00a0una semana para detallar c\u00f3mo facilitar\u00eda la presentaci\u00f3n de impugnaciones legales por parte de los deportados.<\/p>\n<p>Cientos de venezolanos fueron deportados en marzo despu\u00e9s de que el presidente Donald Trump invocara la\u00a0<strong>Ley de Enemigos Extranjeros de 1798<\/strong>\u00a0para deportar r\u00e1pidamente a presuntos miembros del extinto\u00a0<strong>Tren de Aragua<\/strong>\u00a0sin pasar por los procedimientos normales de inmigraci\u00f3n.<\/p>\n<p>En este contexto, el fallo de Boasberg de este mi\u00e9rcoles es el primero que aborda el destino de estos detenidos.<\/p>\n<p><strong>Ni la Casa Blanca ni el Departamento de Justicia han respondido al respecto<\/strong>.<\/p>\n<p>Los familiares de muchos de los venezolanos deportados el 15 de marzo y sus abogados\u00a0<strong>niegan que los migrantes tuvieran v\u00ednculos con pandillas<\/strong>\u00a0y dicen que no se les dio la oportunidad de refutar las acusaciones de la administraci\u00f3n Trump en los tribunales.<\/p>\n<p>En este sentido, la Corte Suprema de Estados Unidos dictamin\u00f3 en abril que los migrantes deben poder impugnar sus deportaciones bajo la Ley de Enemigos Extranjeros.<\/p>\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\">\n<div tribunales de todo el pa\u00eds han prohibido a la Administraci\u00f3n Trump realizar m\u00e1s deportaciones de presuntos miembros del desaparecido Tren de Aragua bajo esta ley.<\/p>\n<p>Boasberg dijo que su decisi\u00f3n de permitir que la Administraci\u00f3n Trump proponga un procedimiento para permitir a los venezolanos presentar impugnaciones legales equilibra la autoridad del poder ejecutivo
